Immigrant advocacy groups, including the ACLU, have launched a lawsuit against the Biden administration, challenging President Biden’s recent move to halt asylum claims at the southern border.
The directive, issued last week, aims to restrict asylum processing when daily encounters with migrants between ports of entry exceed 2,500, with limitations remaining until encounters drop below 1,500 on average over seven days.
The ACLU and allies contend that the suspension of asylum for those not entering through designated ports violates federal immigration law, arguing that the U.S. has historically provided refuge for those fleeing persecution.
The Department of Homeland Security asserts the legality of the “Securing the Border” rule, emphasizing its importance in bolstering border security.
Biden’s policy stipulates immediate removal for migrants who fail to express fear of returning home, with potential penalties including a five-year ban on reentry or criminal prosecution.
