A Finnish court has ordered the release of a Nigerian mother and her two young children from the Joutseno detention centre, offering a significant victory for migrant families trapped in the asylum system across Europe.
After nearly two months behind the locked gates of the Joutseno detention centre in Eastern Finland, the family, consisting of a 27-year-old woman and her children, ages two and six, will now find temporary respite in a nearby open reception centre while Finnish authorities review their asylum application.
The Finnish court ruling came after the Eastern Finland Court of Appeal stated that detaining the children was unjustified. The court asserted that Finnish law, which allows for child detention only as a last resort, had not been properly followed.
The mother’s journey to Finland, marked by hardship and trauma, began in Italy, where she fled an abusive husband and escaped the horrors of forced sex work. Her first asylum application was denied because she had not disclosed her past. But when she and her lawyer, Emmi Wehka-aho, presented a fuller account of her history, the case took a pivotal turn.
“We’re pleased with the Court’s decision,” said Wehka-aho. “The court acknowledged the children’s perspective, but the requirement to report twice a day remains unreasonable.”
While they are no longer behind bars, the family’s path to safety is still fraught with challenges. They are required to check in twice a day at the Joutseno centre while awaiting the next decision. Should they be granted asylum, they hope to return to Pori, where they had started to rebuild their lives.
